Federal Sentencing Law Changes - Amendment #706

While this particular issue may not pertain to a majority of you, it is hoped that you as a fellow blogger will help to spread the word.

On November 1, 2007, the U.S. Sentencing Commission voted unanimously to make changes in the way that defendants convicted under the "crack cocaine" laws were sentenced. This was voted on by the U.S. Congress, and made "retroactive"to approximately 20,000+ Federal prison inmates Nationwide. With an effective date of March 3, 2008.

As of march 3, 2008, over 400+ Petitions Filed Nationwide for Sentence Reduction under U.S. Sentencing Guidelines - Amendment #706: Crack/Powder Cocaine Disparity.

Here, at J. An example: A prisoner sentenced under Base Offense Level 38, may now have that reduced to a Base Offense Level of 36, let's use this example to help clarify things for you:

John Doe, is a defendant with a Criminal History Score (CHS) of III, and a Base Offense Level of 38, with a Sentencing Range of 292-365 months imprisonment. At Sentencing, the Court sentenced him to the "low end" being 292 Months imprisonment. Now, under Amendment #706, john Doe's Base Offense Level is reduced to Base Offense Level 36, which has a Sentencing Range of 235-293 Months Imprisonment. The District Court must now sentence him at the "low end" to 235 Months, a difference of 57 Months (4 years, 9 months).
